Buying an apartment in Burgas as a foreign citizen: documents and land rights

Foreign citizenship does not automatically prevent an apartment purchase in Bulgaria. However, ownership of the dwelling and ownership of land are separate questions. Before reserving, establish exactly what the chosen property includes and which rules apply to your citizenship and circumstances.

An apartment viewing usually starts with layout, price and completion dates. An international buyer needs another early step: confirmation of the acquisition structure by the notary and legal adviser. Documents can then be prepared for the actual transaction rather than a general promise that foreigners can buy.

Separate the apartment from the land

The official ownership portal distinguishes foreign ownership of buildings and limited rights in property from ownership of land. Article 22 of the Bulgarian Constitution sets separate conditions for land. An advertisement simply describing an apartment is therefore not enough.

Request the description of the individual unit, common parts and rights over the plot. Undivided shares in land are different from a right to build. A rendering or a building's garden does not resolve that distinction.

This does not establish which plot rights accompany a particular Magnolia apartment. Those need to be identified from the selected unit's documents.

Clarify citizenship before choosing the structure

EU and EEA citizens and citizens of other countries should not be treated as having identical rules for acquiring land. The official explanation sets out the separate grounds and conditions. A transaction-specific check should identify your citizenship, any additional nationality and the rights being acquired.

Do not form a company just because somebody says every foreign buyer needs one. First establish whether it is necessary and appropriate. A company brings separate administrative and tax considerations that continue after the keys are handed over.

Prepare documents for your circumstances

Request an individual document list from the notary and lawyer in advance. It should address identification, marital status and the applicable property regime, together with the other requirements of your transaction. A list used by another buyer is not necessarily sufficient.

Clarify which foreign documents require originals, translation or authentication for use in Bulgaria. The answer depends on the document and issuing country. Do not order an apostille for everything without specific instructions.

If buying during marriage, include any international element in the legal discussion. Who pays the price and who acquires ownership are separate questions. An arrangement used for Bulgarian spouses should not be applied mechanically to every foreign couple.

Translation needs planning

Where a participant does not know Bulgarian and the notary does not know the language they use, Civil Procedure Code Article 582 provides for an interpreter. That is different from having an English version of the sales offer.

Compare the draft agreement and its translation before signing. You need to understand the property, payments, deadlines and consequences of non-performance. Arrange interpreting with the notary early. Do not assume a Bulgarian-speaking friend automatically meets the procedural requirements.

If you will not attend personally, discuss the power of attorney's exact scope and form. Check any foreign certification separately rather than assuming a broad authorisation used elsewhere will suffice.

Coordinate bank transfers and deadlines

Before reserving, ask your bank about the cross-border transfer, currency, source documentation and processing time. A written answer is useful. Do not schedule a contractual deadline on the assumption that every international transfer arrives instantly.

If relying on a mortgage, obtain separate assessments of you and the property. Eligibility to own an apartment does not guarantee lending. A product for Bulgarian citizens earning abroad is not evidence that identical terms are available to a foreign citizen.

For an apartment under construction, compare accessible funds with the seller's payment schedule. The relevant planning issue is discussed in Magnolia's off-plan mortgage guide. Its general explanation does not confirm lending eligibility for your citizenship.

Ownership is not automatic residence permission

Do not treat the deed as an automatic residence permit. The Ministry of Interior handles migration grounds and procedures separately. If your aim is long-term living in Bulgaria, investigate residence independently of the property selection. No visa or residence entitlement is promised here in return for a purchase.

Start with Magnolia's available apartments. For the chosen unit, request property documents, the plot-rights description, a draft agreement and the current payment schedule. These allow advisers to assess your actual purchase rather than answer for foreign buyers in general.
